    El Estado de Chile ha asumido la tarea de reforzar la agenda Mujer, Paz y Seguridad en las distintas instancias multilaterales en las que participa.  En el plano internacional, Chile apoyó con fuerza la iniciativa del Consejo de Seguridad de hacer evidente y asumir la responsabilidad de proteger a las víctimas, mujeres y niñas, de los consecuencias de los conflictos de los últimos años y fue uno de los primeros países en acoger la Resolución 1325.  Más tarde el año 2009 promulgó la primera política para implementar dicha Resolución, la que se ha ido perfeccionando con el tiempo y actualizando según las directrices y mandatos de Naciones Unidas.  Hoy, el país ejecuta el 2º Plan de Acción, cuya vigencia cubre el período 2015-2018.

     

    Este Plan que transita por las políticas de defensa, exterior y equidad de género, implica que Chile sea parte de iniciativas globales para fortalecer la implementación de la agenda “Mujeres, Paz y Seguridad”, potenciando la responsabilidad nacional y de otros Estados de integrar esta visión en las políticas y marcos normativos nacionales. Al respecto, al ser Chile el primer país de América Latina en publicar un Plan de Acción de la Resolución 1325, cuenta con un liderazgo que lo ubica entre los países promotores de esta Agenda en instancias tales como el Grupo de países Amigos de la Resolución 1325 y la Red de Puntos Focales, primer foro interregional sobre este tema.

    Chile ha incluido decididamente, como parte de sus definiciones en materia de cooperación en el sector de la Defensa, su experiencia en la implementación de políticas de “género y seguridad”.  En concreto, en la inclusión en los programas de "Grupos de género" en el Consejo de Defensa de UNASUR (CDS-UNASUR) como en la CDMA

    Los esfuerzos realizados apuntan, de manera directa o indirecta, a responder a los principios de la Resolución 1325 y las resoluciones posteriores.  Las políticas del sector de la defensa en este ámbito se orientan a proteger a las víctimas, ampliar la participación de las mujeres y transversalizar la perspectiva de género en la planificación de las operaciones.

    La materialización de los compromisos asumindos en los grupos de trabajo de Género en el CDS-UNASUR y a nivel hemisférico en la Conferencia de Ministros de Defensa de las Américas (CMDA)

    Desde la década del 90 y en particular desde el año 2000 en adelante, el país ejecuta una política para incentivar la participación de las mujeres en las Fuerzas Armadas, lo que en el marco de las operaciones de paz significa que cuenta, potencialmente, con personal femenino en condiciones de participar y ser desplegado a una operación de paz.  También se ha trabajo para que las mujeres uniformadas se integren en igualdad de condiciones que los hombres, eliminado todo tipo de discriminación arbitraria.  Hoy las mujeres pueden desarrollar sus carreras militares en todas las áreas tanto en el Ejército como en la Fuerza Aérea.  Además, se han ampliado o abierto cupos para la conscripción femenina en las tres ramas de las Fuerzas Armadas.

     

    Al respecto, si bien hoy el efecto no es inmediato, el trabajo de incorporación de mujeres en las Fuerzas Armadas constituye un potencial para integrar futuros contingentes desplegados a operaciones de paz. Actualmente, las mujeres representan el 14.4 % de las FFAA, considerando oficiales, cuadro permanente o gente de mar, soldados de tropa profesional, empleadas civiles de planta, y soldados conscriptos:

    En el Ejército: 14.9%

    En la Armada: 11%

    En la Fuerza Aérea: 18,2%

     

    Durante el año 2016, Chile participó de 7 operaciones de paz, ya sea a través de tropas desplegadas o de observadores militares:

    4. República Centroafricana (1 mujer)

    Como parte del Segundo Plan de Acción Nacional (PAN) se ha fomentado su difusión, el diálogo con la sociedad civil y capacitaciones en la materia, dirigidas a participantes de la esfera civil y militar, tanto a nivel nacional como también a través de la cooperación y participación de países de América Latina y El Caribe y de otras regiones, con énfasis en los contenidos conceptuales de género, defensa, paz y seguridad. En especial, estas capacitaciones, traducidas en seminarios, talleres, mesas de diálogo y cursos se fundamentan en los principales instrumentos internacionales relacionados con los derechos humanos de las mujeres y niñas, además de la Resolución 1325 (2000) y otras resoluciones relacionadas. De manera complementaria, en gran parte de las actividades, se abordó la situación del conflicto en la región y sus impactos en la población local, en especial la violencia de género, la violencia sexual y los mecanismos de implementación de la Resolución 1325.

     

    Respecto a la formación de las y los militares.  A partir del 2018 se incorpora en las mallas curriculares de las Escuela Matrices un “Núcleo básico de derechos humanos”, que considera materias relativas a la inclusión y no discriminación, dimensiones específicas de derechos humanos en el ámbito de las mujeres, niños, pueblos indígenas, personas con discapacidad, diversidades sexuales, migrantes y refugiados, así como las materias propias de la resolución 1325.

    Centro Conjunto de Operaciones de Paz de Chile capacita a civiles y militares en los cursos de “Introducción a las Operaciones de Paz y Gestión de Crisis para Civiles”, de “Protección de Civiles” y de “Operaciones de Ayuda Humanitaria” que permite que la sociedad civil tenga conocimiento durante misiones humanitarias.

    Por su parte, el Centro Conjunto de Operaciones de Paz de Chile capacita a civiles y militares en los cursos de “Introducción a las Operaciones de Paz y Gestión de Crisis para Civiles”, de “Protección de Civiles” y de “Operaciones de Ayuda Humanitaria”, permitiendo que miembros de la sociedad civil tenga los conocimientos necesarios para actuar en misiones humanitarias. –

    1. En la Armanda, se incorporó la Resolución ONU N° 1325 "Mujer, Seguridad y Paz" a los temas de investigación anual de la Academia de Guerra del Ejército (TIAAG) 2016 - 2017, específicamente en el área de investigación "Fuerzas Armadas y Sociedad" y en la línea de investigación "Relaciones Civiles - Militares", con los siguientes temas:
    • La R1325/2000 de la ONU en el Ejército de Chile.

    Plan Nacional de Acción contra la Violencia Hacia la Mujer (2014-2018), contempló las siguientes acciones: aumento centros de la mujer, aumento casas de acogida (incluyendo una casa destinada a mujeres vulneradas por la Trata de Personas y Migrantes en situación de explotación), el Programa Nacional de Formación de Monitoras/es Comunitarios en Materias de Violencia de Género, y los mecanismos de coordinación con organismos gubernamentales, que se encuentran vigentes actualmente: a) Protocolo entre juzgados de Familia y SERNAMEG, b) Convenio entre CAJ y SERNAMEG, c) Circuito Intersectorial de Femicidios, d) Red de Asistencia de Víctimas, e) Convenio de Colaboración intersectorial subsecretaría de carabineros y SERNAMEG, f) Convenio de colaboración MINVU-SERNAMEG, g) convenio de colaboración y acción conjunta del DEM del Ministerio del Interior y SERNAMEG, h) Salas de Familia de Carabineros para casos de violencia intrafamiliar, y violencia contra mujeres y, niños, niñas y adolescentes; i) Convenio de Colaboración Interministerial para la aplicación de la Pauta Unificada de Evaluación Inicial de Riesgo en mujeres Víctimas de Violencia Intrafamiliar en Contexto de Pareja y Protocolo de protección Inmediata; j) Mesa Intersectorial sobre Trata de Personas, k) Plan de Acción Nacional contra la Trata de Personas. El último trimestre de 2017, SERNAMEG realizó talleres con Servicio Médico Legal y Policía de Investigaciones, el “Taller de Atención a las Mujeres e Investigación y Peritajes en las Causas de Violencia contra las Mujeres” y “Taller de Atención a las Mujeres e Investigación y Labor Forense en los casos de violencia contra las mujeres”, respectivamente.

    Implican el desafío de generar mayor información, y bases de datos que contemplen una mayor cantidad de indicadores.

    Implementar Plan Nacional de Igualdad entre Hombres y Mujeres 2018-2030 y de DDHH. Programa Nacional de Formación de Monitoras/es Comunitarios en Violencia contra las Mujeres. Curso e-learning “Herramientas para el abordaje de la VCM”. Tramitación proyecto de ley sobre violencia en el pololeo (N° boletín 8851-18). Articular y coordinar nuevo Plan Nacional de Acción contra la Violencia hacia las Mujeres 2018-2022.

    Se requiere alinear esfuerzos con el cumplimiento de la Agenda 2030. En Chile, a través del Consejo Nacional para la implementación de la Agenda 2030 para el Desarrollo Sostenible, organismo encargado de asesorar al Presidente de la República respecto a la implementación y seguimiento de la Agenda 2030 y los ODS a nivel nacional, y coordinar a los distintos organismos involucrados.

    Programa Nacional de Formación de Monitoras/es Comunitarios en Materias de Violencia de Género, busca articular y fortalecer el tejido social comunitario, para prevenir la violencia hacia las mujeres. Entre 2015 y 2017 se capacitó a 5.885 dirigentas comunitarias, quienes replicaron sus conocimientos a más de 200.000 personas de las comunidades.

    IHL and IHRL compliance and accountability

    - Respecto de la Enmienda de Kampala, al Estatuto de Roma, sobre el crimen de agresión, Chile ratificó dicha enmienda el 23 de septiembre de 2016.

    - Respecto de la Enmienda de Kampala, al Estatuto de Roma, sobre el artículo 8, Chile ratificó dicha enmienda el 23 de septiembre de 2016.

    - Nuestro país creó en 1994 la Comisión Nacional de Derecho Humanitario, interministerial, que se reúne periódicamente con el objeto de trabajar en la implementación de distintos instrumentos de Derecho Internacional Humanitario. 

    - Entre el 28 y 29 de marzo de 2017, Chile participó en la “Segunda Conferencia Internacional sobre Escuelas Seguras”, realizada en Buenos Aires, Argentina.

    En virtud del Decreto Supremo del Ministerio de Relaciones Exteriores Nº 1.229 de 31 de agosto de 1994, que crea la Comisión Nacional de Derecho Humanitario, se procede a informar a S.E. la Presidenta de la República sobre las actividades realizadas por la Comisión. Las actividades informadas, se encuentran en la agenda de la Comisión.

    Muchos de los desafíos que tiene Chile en materia de Derecho Internacional Humanitario, dicen relación con la implementación de normas, lo que involucra a múltiples instituciones que requieren de coordinación y tiempo, atendido que muchos de ellos requieren dictación de normas y decretos, así como trámites legislativos.

    La Comisión Nacional de Derecho Humanitario tiene planificado reunirse una vez cada tres meses durante el año 2018. Los temas informados en este reporte, están en la agenda de trabajo de la Comisión.

    Se requiere poner el foco en la coordinación institucional, a fin de alinear políticas y marcos normativos.

    Se busca reconocer a las mujeres como agentes activas en el proceso de prevención y mitigación. Se elaboró ​​el “Plan de Emergencia Sectorial del Sector Salud”, que incorpora la perspectiva de género en sus herramientas para evaluación de daños y necesidades del sector salud, en todos sus niveles; reconociendo las diferencias que presentan mujeres y hombres ante situaciones de desastres, tales como niveles de vulnerabilidad, acceso a recursos, percepción del riesgo, manejo de información, reacción al estrés, y rol al interior de las comunidades y/o grupos familiares, entre otras.

    Continuación de la Plataforma Nacional para la Reducción del Riesgo de Desastres, e Implementación del Plan estratégico Nacional para la Gestión de Riesgo de Desastres que incluyó las siguientes actividades: mesa de niños, niñas y adolescentes, incorporación de información desagregada por sexo en los instrumentos del sistema de evaluación de daños y necesidades, kit de higiene personal de mujer, hombre y niño -niña, inclusión del enfoque de género en la Guía de Administración de Albergues Municipales, curso de gestión de riesgo y género dirigido a funcionarios/as públicos/as con responsabilidad en las temáticas, incorporación de género en recomendaciones y documentos generados por el Departamento de Programas, incorporación de contenidos de género en cursos e-learning de la Academia Nacional de Protección Civil, incorporación de contenidos con enfoque de género en las capacitaciones de participación comunitaria (microzonificación de riesgos y recursos y otros).

    A nivel multilateral, realizar III curso de Perspectiva de género en Defensa”: Actividad comprometida por Chile en el Consejo de Defensa Suramericano (CDS/UNASUR. 

    Y avanzar en los objetivos del Grupo de Trabajo de la Conferencia de Ministros de Defensa de las Américas (CMDA).

    Se requiere alinear esfuerzos con el cumplimiento de la Agenda 2030. En Chile, a través del Consejo Nacional para la implementación de la Agenda 2030 para el Desarrollo Sostenible, organismo encargado de asesorar al Presidente de la República respecto a la implementación y seguimiento de la Agenda 2030 y los ODS a nivel nacional, y coordinar a los distintos organismos involucrados. Por otro lado, se requiere un trabajo intersectorial.
